Qinsi Business Management Privacy Protection Agreement

This "Qinsilk Warehouse Inventory Management Privacy Protection Agreement" (hereinafter referred to as "this Agreement") applies to the Qinsilk Warehouse Inventory Management app and other Qinsilk products and services (hereinafter referred to as "Qinsilk" or "we"), except for other third-party products or services you access through the platform's products and services. Before you click to agree to this Agreement, please read and fully understand the content of each term carefully, especially the terms that exempt or limit liability, the applicable law, and dispute resolution terms. The terms that exempt or limit liability will be identified in bold, and you should pay special attention to them. If you have any questions about the Agreement, you can contact Qinsilk in the manner listed in this Agreement.

When you click to confirm your agreement to this Agreement, it means that you have fully read, understood, and accepted all the contents of this Agreement, and have reached a consensus with Qinsilk. This Agreement is legally binding on both you and Qinsilk.

I. Definitions

1.Qinsilk Products and Services: Refer to the products and services provided to you by Shenzhen Qinsilk Technology Co., Ltd. (the Developer) through the following channels: including but not limited to the Qinsilk website, mobile applications, clients, related WeChat Open Platform accounts or mini-programs, and the Qinsilk Software Development Kit (SDK) and Application Programming Interface (API) for use by third-party websites and applications, and products and services provided by Qinsilk-affiliated companies without an independent privacy agreement, etc.

2.Other Third-Party Products or Services: Include but are not limited to products or services provided to you by other trading parties, third-party websites, and third-party service providers other than Qinsilk.

3.Partners: Refer to third-party information systems, social platforms such as WeChat/QQ for third-party logins, and other third-party entities or platforms thatQinsilk cooperates with to implement some functions, provide better customer service, and enhance user experience.

4.Personal Information: Refers to various information recorded electronically or otherwise that can be used alone or in combination with other information to identify a specific natural person's identity or reflect the specific natural person's activities.

5.Personal Sensitive Information: Refers to personal information that, if disclosed, illegally provided, or abused, may endanger personal and property safety, and is highly likely to cause damage to personal reputation, physical and mental health, or result in discriminatory treatment. This includes identity document numbers, mobile phone numbers, personal biometric information, bank accounts, financial information, track record, transaction information, and personal information of children aged 14 and under (inclusive).

6.Deletion of Personal Information: Refers to the act of removing personal information within the systems involved in the daily business functions, making it unsearchable and inaccessible.

II. User Rights and Obligations

1.You understand and agree that in order to enjoy our services, you must prepare the necessary equipment and bear the following expenses:

 

1.1 Internet access devices: Including but not limited to computers or other internet terminals, modems, and other essential internet devices;

1.2 Internet access expenses: Including but not limited to internet access fees, rental fees for internet devices, mobile data charges, etc.;

2.The term "user" or "you" as used in this agreement refers to an individual who has the civil conduct and liability capacity to enjoy the relevant services of Qinsilk. If you are a minor (including children under the age of 14) or a person with limited civil conduct capacity or without civil conduct capacity, you must read this agreement in the company of a guardian or legal representative, and have the guardian or legal representative complete the click confirmation and consent on your behalf. The platform's collection of the click confirmation and agreement operation records of this agreement is considered as the consent made by your guardian or legal representative, and you and your guardian or legal representative have fully read, understood, and accepted all the contents of this agreement, and have reached a consensus with Qinsilk. This agreement is legally binding on you, your guardian or legal representative, and Qinsilk.

3.You understand and guarantee that the information you provide during the use of this service is true, accurate, and complete, and that the information is effectively updated in a timely manner in case of any changes. If any damage is caused to you or a third party in person or property due to the reasons mentioned above, Qinsilk shall not be held responsible.

4.You understand and guarantee that in the process of enjoying the relevant services of Qinsilk, you will not violate the provisions of relevant laws and regulations in mainland China of the People's Republic, and will not use the Qinsilk services to engage in illegal activities. You will bear all responsibilities for all information and remarks you publish within Qinsilk.

III. Platform Liability

1.Qinsilk strictly collects, uses, stores, and shares your personal information in accordance with this agreement and the provisions of relevant laws and regulations such as the "Cybersecurity Law of the People's Republic of China" and the "Personal Information Security Specification." In case this agreement does not make clear provisions on the protection of personal information, the provisions of the "Cybersecurity Law," the "Personal Information Security Specification," and other relevant laws and regulations shall prevail. Except for faults of Qinsilk, you shall bear the risks arising from the use of Qinsilk services. If you suffer personal injury, property damage due to your own fault or actions, or if third parties suffer personal injury, property damage caused by you or by a third party, you shall pursue legal liability from the responsible party according to law, and Qinsilk shall not be responsible.

2.Qinsilk will make reasonable commercial efforts to ensure the security of your data storage in Qinsilk and its services, but Qinsilk cannot provide a complete guarantee that your personal information will not be violated. Qinsilk is not responsible for the deletion or storage failure of your data in Qinsilk and its services, and you can back up the relevant data in Qinsilk and its services according to your own needs.

3.If you violate this agreement, Qinsilk reserves the right to suspend or terminate the provision of all Qinsilk services to you, and also has the right to refuse to provide services, close personal accounts, clear or edit content, cancel orders, and delete all kinds of content that does not comply with legal provisions or is not true without notifying the user.

4.You understand and agree that the personal information protection measures provided in this agreement only apply to the Qinsilk software and related services. Once you leave the Qinsilk software and related services, browse or use other websites, services, and content resources, we do not have the ability and obligation to protect any personal information you submit in software and websites outside the Qinsilk software and related services, regardless of whether you log in, browse, or use the above software, websites based on Qinsilk's links or guidance.

5.You understand and agree that in the process of using this service, you may encounter factors such as force majeure and technical risks, which may cause the service to be interrupted. 5.1 Due to force majeure factors such as natural disasters, strikes, riots, wars, government actions, or judicial administrative orders.

5.2 Failures or other reasons in your or Qinsilk's computer software, systems, or hardware that result in your inability to use Qinsilk.

5.3 Due to public service factors such as power supply failures, communication network failures (including but not limited to electronic communication transmission failures or delays, interception or manipulation of electronic communications by computer programs used for electronic communications), your own factors (including but not limited to improper operation, use of the service through unauthorized means byQinsilk), or third-party factors (including but not limited to damage caused by computer viruses, Trojans, or other malicious programs, hacker attacks, incorrect orders by customers, and other incorrect operations).

5.4 Despite Qinsilk's good faith management, due to routine or emergency equipment and system maintenance, equipment and system failures, defects, network information and data security, technical risks, and other factors.

5.5 You are aware and understand that Qinsilk will fulfill its reasonable duty of care to the greatest extent to maintain the accuracy of Qinsilk's data. However, due to objective reasons such as Internet technology factors, there may be lags or errors in the information displayed on the web pages of Qinsilk, which will be repaired as soon as possible after discovery.

5.6 Other circumstances that Qinsilk cannot control or reasonably foresee.

6.In the following circumstances, the platform shall not bear any responsibility unless it is due to the platform's intentional or negligent acts:

6.1 Any disclosure of personal information caused by you sharing your user password with others or sharing your registered account with others.

6.2 Any leakage, loss, theft, or alteration of personal information caused by hacker attacks, computer virus invasions or outbreaks, or temporary closures due to government control, and other force majeure events that affect the normal operation of the network.

6.3 Any leakage of personal information caused by other third-party products or services related to Qinsilk, and any legal disputes and consequences arising therefrom.

7.Qinsilk is only responsible for compensating users for direct and actual losses caused by Qinsilk in accordance with the law, and does not assume responsibility for any indirect losses or punitive damages.

(I) How the Platform Collects and Uses Your Personal Information

1.Types of Information Collected and Their Purposes

The platform collects and uses your personal information for the following purposes stated in this agreement. Unless necessary for basic business functions or required by relevant laws and regulations, refusing to provide the following information will only prevent you from using specific features, but it will not affect your normal use of other Qinsilk functions:

1.1 Information Required to Provide Platform Functionality

1.1.1 Account Information: To become a Qinsilk user and for the platform to provide you with services, you need to provide basic registration or login information. You can choose to create an account and log in to Qinsilk products or services through mobile phone login ("Account Login"). When choosing the mobile login method, you must provide us with your mobile phone number. We collect this information to identify and verify your identity. This also helps Qinsilk to bind your mobile phone number with the Qinsilk account, enabling data synchronization across different devices under this account.

1.1.2 Personal Profile and Service Item Information: During the registration and login process for some individual services, if you provide additional information (such as your name, store/company name, email, industry attributes provided by your account), it will help the platform to provide you with a better service experience. However, if you do not provide this information, it will not affect your use of the basic functions of Qinsilk.

1.2 To provide services that better fit your needs, you will provide information to the platform and associate it with these functionalities and information, including:

1.2.1 Address and Contact Information: When you purchase products on the Qinsilk platform and use delivery/mail services, you are required to provide the name, phone number (for the courier to contact you, such as Ms. Wang), mobile phone number, delivery address, and house number of the recipient to ensure that your order is delivered safely and accurately. Additionally, when you require Qinsilk to provide offline door-to-door services or localized services, filling in your address helps us arrange for consultants to provide services at your door conveniently. However, if you do not provide this information, it will not affect your use of the basic functions of Qinsilk.

1.2.2 Order and Payment Information: When you purchase hardware or software on the Qinsilk software and related platforms, you can choose the payment services provided by the third-party payment institutions (such as WeChat Pay, Apple Pay, Alipay payment channels) that cooperate with Qinsilk. The payment function itself does not collect your personal information, but the platform needs to share your Qinsilk order information and accounting information with these payment institutions to confirm your payment instructions and complete the payment.

1.2.3 Content You Post on the Platform: When you actively post content on the Qinsilk platform (such as article comments and other information), the platform will collect the information you post and display your nickname, avatar, and published content.

1.2.4 Customer Service-Related Communication Record Information: When you contact the platform's customer service, the platform's system may record the communication records between you and the customer service, as well as use your account information for identity verification.

1.3 To provide services that better fit your needs, the platform will collect information about your use of products, services, and the manner of use, and associate this information, including:

1.3.1 Device Information: The platform will receive and record information related to the device you use according to the specific permissions you grant during the installation and use of the software (device model, operating system version, device settings, network device hardware address Mac, unique device identifier hardware and software feature information (IMEI/android ID), installed application list). The collection of this information is to ensure the safe operation of the software and services to provide you with continuous and stable service support (such as real-time data synchronization), and it also helps Qinsilk to continuously improve its products or services, so that you can get the best experience in the process of using Qinsilk's products or services. If you do not provide device-related information, when you use the function and encounter problems, the platform will not be able to promptly identify the cause of the problem.

In addition, to ensure the safety of your device operating environment and to provide our products and/or services, to prevent the installation of malicious programs and anti-cheating, and to count the activity of mobile applications on end-user devices, we will obtain the necessary application/software list information (including application/software source, overall operation of application/software, crash situation, usage frequency) installed on or running on your device after you agree to this agreement. Please be aware that the application/software list information alone cannot identify your specific identity. We use the unique device identification code to uniquely identify users for user data statistics. In special cases (such as when users use tablet devices or TV boxes), when the unique device identifier cannot identify the device, we will use the device Mac address as the unique identifier for users to provide normal statistical analysis services.

1.3.2 Log Information: When you use the products or services provided by the platform's website or client, the platform will automatically collect your detailed use of the platform services as related network logs (your search query content, IP address, type of browser, telecommunications operator, language used, date and time of access, records of web pages you visit, call status information).

Please note that device information and log information alone cannot identify the identity of a specific natural person. If the platform combines this non-personal information with other information to identify a specific natural person, or uses it in combination with personal information, during the period of combined use, this non-personal information will be treated as personal information. Except with your authorization or otherwise stipulated by laws and regulations, the platform will anonymize such personal information.

1.3.3 Information Related to Your Transactions and Payments Provided by Third Parties: In order to provide you with better quality services and to confirm the status of transactions and provide after-sales and dispute resolution services for you, after your authorization, the platform will collect your transaction and payment information related to the transaction progress through the third-party information systems, payment institutions, etc., that you choose and are directly involved in the transaction, to facilitate the platform to process your orders and ensure the smooth completion of services, or to better prevent fraud, brush orders, and other malicious behaviors.

1.4 To provide you with the corresponding platform features, the platform needs to obtain the following permissions:

1.4.1 Read and Write Storage Permissions: When you access Qinsilk, in order to normally use the data entry/data export/picture entry/update APP/log caching required for the APP to run, the platform needs to obtain your read and write storage permissions. If you do not enable this permission, you will not be able to use specific features related to this permission, but it will not affect your use of other services provided by the Qinsilk APP.

1.4.2 Camera and Album Permissions: When you use the product management to enter pictures, enter avatar pictures, scan product barcodes, recognize hangtags, and insert pictures during customer service communication, in order for you to take real-time photos, the platform needs to obtain your camera permissions and/or album permissions. If you do not enable this permission, you will not be able to use specific features related to real-time shooting, but it will not affect your use of other services provided by the Qinsilk APP.

1.4.3 Phone Permissions: To facilitate you making direct calls through the customer management feature in the Qinsilk software, Qinsilk needs to obtain your phone permissions. If you do not need the above service, you can choose not to enable this permission, and it will not affect your use of other services provided by the Qinsilk APP.

1.4.4 Microphone Permissions: When you use the voice input function in the customer service feature, we will collect your voice content through the microphone, transmit it to the customer service staff through encrypted transmission, and provide you with a more convenient customer service function. The customer service staff cannot save and forward your voice data. In addition, you also need to record audio through the microphone when using the voice search for products feature. If you do not need the above service, you can choose not to enable this permission, and it will not affect your use of other services provided by the Qinsilk APP.

1.4.5 Contact Permissions: When you use the customer management feature in the software, you need to import contact information from your address book to better manage your customers. If you do not need the above service, you can choose not to enable this permission, and it will not affect your use of other services provided by the Qinsilk APP.

1.4.6 Location Information Permissions: To provide you with more convenient localized services, Qinsilk needs to read your geographical location to arrange service consultants closer to you to provide software training and hardware installation training services. If you do not need the above service, you can choose not to enable this permission, and it will not affect your use of other services provided by the Qinsilk APP.

1.4.7 Bluetooth Permissions: When you use the Qinsilk software for interoperability with other hardware, the provider of the other hardware can enable the Bluetooth data transmission function after your consent, mainly for connecting Bluetooth scanners and Bluetooth printers and other hardware devices for managing stores. If you do not enable this permission, you will not be able to use Bluetooth-related functions and services, but it will not affect your use of other services provided by the Qinsilk APP.

Please note that once you have enabled the relevant permissions or submitted the relevant information, it means that you have actively authorized us to use your mobile phone and related information. If you turn off the relevant permissions (permission off path: phone settings -> app management -> APP -> permissions), it means you have canceled these authorizations, and we will no longer continue to collect and use your personal information. Your decision to turn off permissions will not affect the processing of your personal information that was carried out based on your authorization before.

1.5 To Provide Security Guarantees

To prevent, detect, investigate fraud, infringement, safety hazards, illegal or violation of agreements, agreements, or rules with the platform or companies associated with the platform, the platform may collect or integrate your user information, service usage information, device information, log information, and information obtained from platform-associated companies and partners with your authorization or shared according to the law.

1.6 Other

The purpose of Qinsilk's collection and use of the above information is to better operate Qinsilk's products and services. When the platform collects your information for other specific purposes not stated in this agreement, it will seek your consent in advance. If the platform ceases to operate Qinsilk products or services, it will promptly stop collecting your personal information, notify you of the cessation of operations in the form of individual delivery or announcement, and delete or anonymize the personal information it holds.

1.7 Exceptions to Obtaining Consent

According to relevant laws and regulations and national standards, we may collect and use your personal information without your consent in the following circumstances:

(1) Directly related to national security or national defense security;

(2) Directly related to public safety, public health, or significant public interest;

(3) Directly related to criminal investigation, prosecution, trial, and execution of judgments;

(4) Necessary to protect your or another individual's life, property, or other significant legitimate interests but difficult to obtain your consent;

(5) The collected personal information is publicly disclosed by you;

(6) Collecting personal information from legally disclosed information, such as legitimate news reports, government information disclosure, etc.;

1.8 Personal Information Authorization

You agree to authorize Qinsilk to verify your basic personal information, financial information, device information, transaction information, service information, and other data or information for purposes such as information backup, operational needs, or at the request of competent departments. You also agree to authorize Qinsilk to collect your basic personal information, financial information, device information, transaction information, service information, and other data.

You agree to authorize Qinsilk to provide your basic personal information, financial information, device information, transaction information, service information, and other data to third parties for the purpose of judging and identifying business risks and improving service quality. You agree to authorize Qinsilk to legally collect your basic personal information, financial information, device information, service information, and other data from third parties in order to provide you with a better user experience and services, and to process them as needed (including but not limited to organizing, saving, processing, associating, and using).

2.Information Usage Methods

The collection of your information is intended to provide and improve the services you use. To achieve this goal, your information will be used for the following purposes. If the platform needs to use the collected information for new purposes, scopes, or actual transmission methods that are inconsistent with the agreement in this agreement, the platform will notify you through a pop-up prompt and obtain your explicit consent:

2.1 To provide you with the Qinsilk products or services you use, and to perform maintenance and updates to give you a better product experience.

2.2 To make targeted recommendations to you, based on your user profile, including but not limited to sending you information about products and services, notification messages, and precise marketing information. The targeted recommendation content can be turned off by logging in and going to [Basic] - [System Settings] - [About] page, and clicking on "Intelligent Services" to close the recommendation service.

2.3 To prevent, detect, and investigate fraud, infringement, safety hazards, illegal activities, or violations of agreements, policies, or rules with the platform or companies associated with the platform, to protect your, other users', or the public's legitimate interests, and the platform or associated companies' legal rights and interests, the platform may use or integrate your user information, service usage information, device information, log information, and information obtained from platform-associated companies and partners with your authorization or shared according to the law, to make comprehensive judgments about your account and transaction risks, conduct identity verification, detect and prevent security incidents, and take necessary recording, auditing, analysis, and disposal measures in accordance with the law;

2.4 For technical needs, the platform must embed third-party software development kits (SDKs). Purpose/Use of Personal Information Collection: To better determine the direction of feature content updates and provide you with a better service experience, we analyze and statistically process your usage data through Umeng. We collect unique device identifiers to uniquely identify users for statistical data such as new user acquisition. 2.5 Currently, Qinsi will not obtain your personal information through platforms other than those mentioned above or through third-party SDKs. If in the future, for the needs of business development, we need to indirectly obtain your personal information from other third-party channels, we will clearly inform you of the source, type, and usage scope of your personal information before obtaining it. If the information processing activities carried out for the business need to exceed the scope of authorization you originally provided to the third party, we will obtain your explicit consent before processing your such personal information. In addition, we will also strictly comply with the relevant laws and regulations and require the third party to ensure the legality of the information it provides.

2.6 Other purposes permitted by you.

3.Storage of Information

The platform will store the collected personal information in the following manner: structured data will be stored within the territory of the People's Republic of China. We will only retain your personal information for the period necessary to fulfill the purposes stated in this agreement, unless there is a mandatory retention requirement by law. For example, the E-Commerce Law of the People's Republic of China requires that product and service information, transaction information be retained for not less than three years from the date of transaction completion; for log information, record backups, and other information, it will be 180 days after your account cancellation (but if the law requires a minimum retention period, we will retain it for the minimum period required by law). For user behavior logs involved in the platform's services, we will process them anonymously. The platform's criteria for determining the aforementioned period include:

3.1 To complete the transaction purposes related to you, maintain corresponding transaction and business records, and respond to your possible inquiries or complaints;

3.2 To ensure the security and quality of the services provided to you by the platform;

3.3 Whether you agree to a longer retention period;

3.4 Whether there are other special agreements on the retention period.

After your personal information exceeds the retention period, the platform will delete your personal information or anonymize it according to the requirements of applicable law (for example, if you are a minor, after your personal information exceeds the retention period, the platform will process your personal information according to the relevant laws and regulations). If it is not possible to delete according to the relevant requirements due to special circumstances, the platform will explain this part to you.

(II) How the Platform Uses Cookies and Similar Technologies

1.Purpose of Using Cookies: To provide you with a smoother access experience, when you use Qinsi's products or services, the platform may collect and store data files from your visits to Qinsi's services using various technologies. These technologies help the platform to recognize your identity when you access or revisit Qinsi's services and analyze data to offer you better and more services. This includes the use of small data files to identify your identity, which serves to understand your usage habits, save you from repeatedly entering account information, or assist in determining the security of your account. These data files may include Cookies, Flash Cookies, or other local storage provided by your browser or associated applications (collectively referred to as "Cookies").

2.Use of Cookies: We will not use Cookies for any purposes beyond those described in this agreement. You can choose to retain or delete Cookies based on your preferences. You can clear all Cookies saved within the software, and once you manually clear them, your related information will be deleted.

(III) How the Platform Shares, Transfers, and Discloses Your Personal Information

1.Sharing

We are committed to keeping your information strictly confidential. The platform will not share your personal information with any company, organization, or individual other than the Qinsi service providers, except in the following cases:

1.1 Sharing with Explicit Consent: The platform will share your personal information with other parties after obtaining your explicit consent.

1.2 Sharing under Legal Circumstances: The platform may share your personal information as required by laws and regulations, for the resolution of litigation or disputes, or as required by administrative or judicial authorities in accordance with the law.

1.3 Sharing with Business Partners: We may share necessary information with business partners to provide services to you. Our business partners include the following types:

Sharing Service Partners: With your authorization, we will only share relevant data with these partners and will not share any personally identifiable information.

We will share necessary data with third parties through Software Development Kits (SDKs), mainly including "WeChat Sharing SDK" and "QQ Sharing SDK". The shared content includes links to shared images, shared web pages, and APP icons. We will conduct strict security checks on third parties and agree on data protection measures.

2.Transfer

The platform will not transfer your personal information to any company, organization, or individual, except in the following cases:

2.1 Transfer with Explicit Consent: The platform will transfer your personal information to other parties after obtaining your explicit consent.

2.2 Transfer in the Event of Merger, Acquisition, or Bankruptcy Liquidation of Qinsi Service Providers: In the event of a merger, acquisition, or bankruptcy liquidation involving Qinsi service providers or other similar situations that involve the transfer of personal information, the platform will require the new company or organization holding your personal information to continue to be bound by this agreement. Otherwise, the platform will require that company, organization, or individual to seek your authorization and consent again.

3.Public Disclosure

The platform will only publicly disclose your personal information under the following circumstances:

3.1 With your explicit consent or based on your voluntary choice, the platform may disclose your personal information;

3.2 If the platform determines that you have violated laws and regulations or seriously violated the rules of Qinsi, or to protect the personal and property safety of Qinsi, its affiliated companies, users, or the public, the platform may disclose your personal information in accordance with laws and regulations or Qinsi's relevant agreement rules with your consent. This includes information about your violations and the measures Qinsi has taken against you.

4.Exceptions to Obtaining Prior Consent for Sharing, Transferring, and Publicly Disclosing Personal Information

In the following circumstances, sharing, transferring, and publicly disclosing your personal information does not require prior consent:

4.1 Related to national security or national defense security;

4.2 Related to public safety, public health, or significant public interest;

4.3 Related to criminal investigation, prosecution, trial, and execution of judgments;

4.4 To protect your or another person's life, property, or other significant legitimate interests, and it is difficult to obtain the person's consent;

4.5 Personal information that you have voluntarily made public;

4.6 Collecting personal information from legally disclosed information, such as legitimate news reports, government information disclosure, and other channels.

4.7 According to legal provisions, sharing or transferring de-identified personal information, and ensuring that the data recipient cannot re-identify the personal information subject, does not constitute an external sharing, transfer, or public disclosure of personal information. The storage and processing of such data will not require additional notice to you or obtaining your consent.

(IV) How the Platform Protects Your Personal Information

1.The platform will take various preventive measures to protect your personal information, ensuring that it is not lost, stolen, misused, or accessed, disclosed, altered, or destroyed without authorization. To ensure the security of your personal information, the platform has strict information security regulations and processes, and a dedicated information security team that strictly implements these measures within the company.

2.Qinsi focuses on data as the core and has established a data security management system around the data lifecycle. It enhances the security of the entire system in multiple dimensions, including organizational construction, system design, personnel management, and product technology.

3.Qinsi will adopt security protection measures that meet industry standards, including the use of encryption technologies such as the Transport Layer Security Protocol for network services to ensure the security of user data during transmission, and isolation techniques for stored data. We also have strict access control measures to prevent unauthorized data acquisition.

4.The platform will take reasonable and feasible measures to avoid collecting irrelevant personal information and will retain your personal information only for the period necessary to fulfill the purposes stated in this agreement, unless there is a need to extend the retention period or within the permissible period allowed by law.

5.The Internet environment is not 100% secure. We will do our best to ensure or guarantee the security of any information you send to us. If our physical, technical, or managerial protective facilities are compromised, leading to unauthorized access, public disclosure, tampering, or destruction of information, resulting in damage to your legitimate rights and interests, we will bear the corresponding legal responsibility.

6.In the event of a personal information security incident, the platform will notify you in accordance with the requirements of laws and regulations and no later than 30 calendar days: the basic situation of the security incident and its potential impact, the measures the platform has taken or will take, suggestions for you to prevent and reduce risks on your own, and remedial measures for you. The platform will inform you of the relevant situation of the incident by email, letter, telephone, push notification, or other means. If it is difficult to notify each individual subject of personal information, the platform will take reasonable and effective measures to issue a public announcement. At the same time, the platform will also report the handling of personal information security incidents to regulatory authorities as required.

7.Due to technical limitations and potential malicious means, even with the utmost effort to strengthen security measures in the Internet industry, it is impossible to always guarantee 100% information security. We will do our best to ensure the security of the personal information you provide to us. Please be aware and understand that the systems and communication networks you use to access our services may have issues beyond our control. Therefore, we strongly recommend that you take proactive measures to protect the security of your personal information, including but not limited to using complex passwords, changing passwords regularly, and not disclosing your account passwords and other personal information to others.

(V) How the Platform Handles the Personal Information of Minors

1.The platform takes the protection of minors' personal information seriously. If you are a minor under the age of 18, it is recommended that you ask your parents or guardians to carefully read this agreement and use the platform's services or provide information to the platform with their consent. In cases where the platform collects personal information of minors with the consent of parents or guardians, the platform will only use, share, transfer, or disclose such information when permitted by laws and regulations, with explicit consent from parents or guardians, or when necessary to protect the minors.

2.Specifically, if you are a child under the age of 14, please ensure that your parents or guardians read this agreement carefully and seek their consent and guidance before using the platform's services or submitting personal information. Only with the consent of your parents or guardians to this agreement can children under the age of 14 use the functions or services provided by the platform. To strengthen the protection of children's personal information, in addition to following other provisions of this agreement, the platform will adhere to the principles of legitimacy, necessity, informed consent, clear purpose, and security protection, and protect children's personal information in accordance with relevant national laws and regulations and the terms of this agreement, as detailed below:

2.1 The platform stores the collected children's information separately from the personal information of users who are not children. The platform will adopt encryption measures that are not lower than the industry standard for storing children's information to ensure its security.

2.2 The platform will appoint a dedicated person responsible for the protection of children's information. Any staff accessing children's information must obtain written approval from the person responsible for the protection of children's information (including electronic information interaction methods such as email, SMS, WeChat, etc.), and keep written records of the access; at the same time, adopt technical measures that are not lower than the industry standard to prevent illegal copying and downloading of children's information.

2.3 When transferring children's information to a third party, in addition to obtaining the consent of the child's parents or guardians again and meeting the above principles, the platform will conduct a security assessment by itself or entrust a third-party institution to do so, and form a written assessment report.

2.4 If the platform collects and uses children's information without the consent of their parents or guardians, upon receiving notice from their guardians, the platform will delete the relevant information as soon as possible.

(VI) How Your Personal Information Is Transferred Globally

In principle, the platform stores within the territory of the People's Republic of China the personal information that is collected and generated during its operation within the country. Additionally, we currently do not have scenarios where personal information is provided overseas. For users outside the People's Republic of China who use Qinsi products and services, and the personal information generated in the process, you agree to transmit and store it on servers within the People's Republic of China; failure to do so will result in the inability to use the existing Qinsi products and services. Under such circumstances, the platform will ensure that your personal information receives protection equivalent to that within the territory of the People's Republic of China.

This policy ensures that regardless of the location of our users, their personal information is subject to the same stringent security and privacy standards that we uphold within China. It is important to note that by using our products and services, you understand and consent to the storage and processing of your information as described. If you do not agree with these terms, you may not be able to utilize the full range of features and services offered by Qinsi.

(VII) Your Rights

1.Accessing Your Information: You can view your existing registration and other provided information in the following ways.

1.1 Account Information: If you wish to access or edit your account's avatar, company name, industry attributes, phone number, address, and other basic personal information, please follow the path by opening the APP, going to My Profile -> Personal Avatar -> Company and Logo Information/Current Account. If you wish to change your password or add security information, you can follow the path by opening the APP, going to My Profile -> Personal Avatar -> Change Login Password.

2.Deleting Your Information: You can delete your user information through the Settings -> About page using the deactivation button, or by contacting the Qinsi platform via its telephone service channel (phone: 400-184-5682), providing relevant information, after which the platform will assist you in deleting your user information. Should the platform cease operations or stop providing related services, it will promptly stop collecting your personal information, notify you of the cessation of operations through individual notices or announcements, and delete or anonymize the personal information it holds.

3.Withdrawing Your Consent or Authorization: Each of the platform's business functions requires some basic personal information to be completed (see this agreement). Beyond this:

3.1 You can withdraw some authorizations by unbinding, modifying personal settings, deleting related information, or by turning off features.

3.2 Once you withdraw your consent or authorization, we will not be able to continue providing the services corresponding to the withdrawn consent or authorization, nor will we process your corresponding personal information. However, your decision to withdraw consent or authorization will not affect the processing of personal information carried out based on your previous consent or authorization.

4.Cancelling Your User Account: You can contact the platform via its telephone service channel (phone: 400-184-5682), provide relevant information, and the platform will assist you in cancelling your account. You understand and acknowledge that account cancellation is irreversible. After you cancel your account, we will stop providing services to you and will delete all information related to your account or anonymize the related information, except as otherwise provided by laws and regulations. After cancellation, you may choose to re-register and log in to the APP to use Qinsi's products and services again.

5.Obtaining a Copy of Your Personal Information: You have the right to obtain a copy of your personal information, which you can do through the telephone service channel by making a call to 400-184-5682.

6.Restricting Automated Decision-Making by Information Systems: In some business functions, we may make decisions based solely on information systems, algorithms, or other automated non-human mechanisms. If these decisions significantly affect your legitimate rights and interests, you have the right to request an explanation from us.

7. Responding to Your Requests

To ensure security, you may need to provide a written request or prove your identity in another manner. We may ask you to verify your identity before processing your request.

We will respond within fifteen working days. If you are not satisfied, you can also contact the platform through Qinsi's online service or telephone service channels for assistance in resolving your issue.

In principle, we do not charge a fee for your reasonable requests. However, for repeated or excessive requests, we will charge a certain cost fee as appropriate. We may refuse requests that are frivolously repetitive, require substantial technical measures (for example, requiring the development of a new system or a fundamental change in existing practices), pose risks to the legitimate rights and interests of others, or are highly impractical (for example, involving information stored on backup tapes).

We will be unable to respond to your requests in the following circumstances:

(1) Related to the obligations of the personal information controller to fulfill the laws and regulations;

(2) Directly related to national security or national defense security;

(3) Directly related to public safety, public health, or significant public interest;

(4) Directly related to criminal investigation, prosecution, trial, and execution of judgments;

(5) The personal information controller has sufficient evidence to show that the subject of the personal information has malicious intent or is abusing rights;

(6) To protect the life, property, or other significant legitimate interests of the personal information subject or other individuals, but it is difficult to obtain consent;

(7) Responding to the request of the personal information subject would seriously harm the legitimate rights and interests of the subject or other individuals or organizations;

(8) Involves trade secrets.
(VIII) How This Agreement Is Updated

Qinsi reserves the right to modify the terms of this agreement when necessary and will notify you through push notifications or in-app pop-up windows. You can review the most up-to-date version of the modified agreement on our platform at any time. If you do not agree with the revised agreement, you have the right to terminate your authorization of the platform. Your continued use of the platform's functions after the agreement has been updated will constitute acceptance of the revised agreement.

For significant changes, the platform will also provide more prominent notifications (including soliciting opinions through in-app pop-ups, public announcements, and even providing pop-up alerts).

The significant changes referred to in this agreement include, but are not limited to:

1.Major changes in the platform's service model, such as the purpose of processing user information and the methods of using user information.

2.Major changes in the platform's control, organizational structure, and other aspects, such as changes in ownership due to business adjustments, bankruptcy, mergers, and acquisitions.

3.Changes in the main entities with which user information is shared, transferred, or publicly disclosed.

4.Changes in the platform's responsible department, contact methods, and complaint channels for handling user information security.

5.High-risk indications in the user information security impact assessment report.

We will also archive previous versions of this agreement for your reference.

V. Explanation of Self-Starting and Associated Starting

1.To ensure that the application can receive broadcast messages pushed by the client normally when it is closed or running in the background, the application must utilize the self-starting capability. This may involve the system sending broadcasts at certain intervals to awaken the application for self-starting or associated starting actions, which are necessary for the implementation of functions and services.

2.When you open content-based push notifications, the application will only redirect to the relevant content after obtaining your explicit consent. In the absence of your consent, there will be no associated starting upon the redirection.

3After you open internally downloaded files, there may be an associated starting of third-party apps.

VI. Intellectual Property Rights

1.Ownership of Intellectual Property Rights: Qinsi and its affiliated companies are the owners of intellectual property rights for this platform. All copyrights, trademarks, patents, trade secrets, and other intellectual property rights related to this platform, as well as all content information associated with this platform (including but not limited to text, images, audio, video, diagrams, interface design, layout framework, related data, or electronic documents, etc.) are protected by the laws and regulations of the People's Republic of China and the corresponding international treaties. Qinsi or its affiliated companies hold the aforementioned intellectual property rights, except for the rights that the relevant right holders are entitled to according to the law.

2.Restrictions on Use: Without the written consent of the platform, the aforementioned materials shall not be directly or indirectly published, broadcast, rewritten or redistributed for the purpose of broadcasting or publication, or used for any other commercial purpose in any media. All of the above materials or any part of the materials may only be saved for private and non-commercial use.

VII. Miscellaneous

1.The titles of all clauses in this agreement are for convenience of reading only and shall not serve as the basis for interpreting or limiting the meaning of this agreement.

2.If any provision of this agreement is deemed to be terminated, invalid, or unenforceable, such provision shall be considered severable and shall not affect the validity and enforceability of the remaining provisions of this agreement.

3.This agreement may exist in multiple languages including Chinese and English. In the event of any conflict between the Chinese version and other language versions, the Chinese version shall prevail.

4.For certain specific products and services, the platform will also formulate specific privacy agreements and explain them to you before providing these specific products and services. If there is any inconsistency between the specific privacy agreement and this agreement, the specific privacy agreement shall apply.

VIII. Governing Law and Jurisdiction

1.The conclusion, effectiveness, interpretation, amendment, supplement, termination, execution, and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China. In the absence of relevant provisions in the law, commercial practices and/or industry practices shall be referred to.

2.Disputes arising from your use of Qinsi services and related to Qinsi services shall be resolved through negotiation between Qinsi and you. If negotiation fails, either party may file a lawsuit in the People's Court of the defendant's domicile.
